1. Acceptance of Terms

By accessing or using Sell2Them.com ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service. The Service is owned and operated by Toms RiDICKulous Corp. ("Company", "we", "us", or "our").

2. Description of Service

Sell2Them provides an AI-powered website builder and eCommerce management platform. Our service allows users to create, manage, and host multiple brand storefronts, sell physical or digital products, and manage email marketing campaigns.

The Service is offered for a flat subscription fee of $7 USD per month, which includes unlimited brands, unlimited domains, and access to all platform features.

3. User Accounts and Responsibilities

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to use this Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.

4. Payment Terms

Sell2Them Subscription: The Sell2Them eCommerce platform is billed on a monthly subscription basis. You will be billed $7 USD in advance on a recurring, periodic basis (each period is called a "billing cycle"). Billing cycles are monthly. The subscription includes a 14-day free trial period. There are no platform transaction fees or commissions on sales—you only pay standard credit card processing fees charged by your payment processor (e.g., Stripe).

Education Platform: Our education/course platform is free to use until you make your first sale. Once you begin generating revenue, the platform collects a 5% commission on each sale. Alternatively, you may upgrade to the $7 USD monthly subscription to eliminate all platform fees, paying only standard credit card processing fees.

Refunds: Due to the 14-day free trial period and the low monthly cost of $7 USD, all subscription payments are non-refundable. We encourage you to fully evaluate the Service during your trial period before subscribing.

Cancellation: You may cancel your subscription at any time through your account dashboard. Upon cancellation, your access to the Service will continue until the end of your current billing period. No partial refunds will be issued for unused time.

5. Intellectual Property

Your Content: You retain all rights and ownership of the content, data, and information you upload, post, or display on or through the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely for the purpose of providing the Service to you.

Our IP: The Service, including its original content (excluding User Content), features, and functionality, are and will remain the exclusive property of Toms RiDICKulous Corp. and its licensors.

6. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm the Company or users of the Service or expose them to liability.

7. Limitation of Liability

In no event shall Toms RiDICKulous Corp., its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
